get a note from the nurse clarifying the treatment situation.
send a copy to the carrier

if you are on good terms with your employer have them contact the carrier for you to get the facts corrected.
if those don't work you'll have to get a court date and have the judge decide.
treatment denied by comp can often be paid by your health insurance.

Ok thankyou, I will give it a shot. I just thought if the employee wanted to change their primary and did, there would have to be some paper trail indicating that, I will let you know what happens. Thanks again.

tHERE IS A REQUEST FORM YOU HAVE TO SIGN AND HAVE APPROVED THROUGH THE STATE DEPT OF INSURANCE, TELL YOUR ADJUSTER TO PRODUCE THE FORM YOU SUPPOSEDLY SIGNED....THAT IS HOW IT IS IN TX AND PROB THERE TOO.

First of all, we need to know what state your claim is in, as each state has different laws in regards to how things are done. Especially when it comes time to changing primary care physicians on your claim.

Unless there is written proof in most cases, a court/judge will not take the word of a claims adjustor. And if there is a new adjustor, there should be something in your file in writing that s/he can find to back this up. If you can't get your assigned adjustor to talk to you, request his/her supervisor and request that they send you a copy of the paper you signed returning your care back to the employee health nurse.

*scratches head* I have always been led to believe that a WC claimants care must be co-ordinated be a licensed physician or a PA. Since when is a health nurse knowledgable enough to diagnose a patient ??

Danitaw63, as I have stated before, you need to be very careful with any information you give other IW's. A change of physician in TX is submitted to the Texas Department of Insurance, Div. of Workers' Compensation, Form DWC-053. A big difference rather than submitting it to the State Dept. of Insurance.
