Medical Not Being Paid
Hello everyone I am hoping to get some advice on how to handle what the Ins is not doing. I settled my case alittle over a yr ago with open medical for life, but to avail the Ins is not paying the Doc bills, prescription's, at this point Medicare and Medicaid have been covering my prescriptions. I really do not want to go back into battle witht he Ins but will if need too. Medical Buy Out what is your opinion on it? As I was thinking about talking with my attorney about it as I am not happy with getting bills they stated in the settlement that they would take care of. Any advice would be greatly appreciated!! Karen, have you informed your lawyer about the doctor bills and prescriptions not being paid? Since you have
Lifetime Open Medical as part of your Settlement, he should be able to take care of things for you with a simple phone call to the IC's lawyer that agreed and signed off on the Settlement.

procedures depend on your state laws.
without knowing your state I cannot be specific.

comp court still retains jurisdiction over the provision of future medical benefits. many states have controls on medical usage and procedures for appealing denials.

since you are medicare eligible any buyout would require that the money be put into a set aside trust account to ensure your comp settlement was used for comp treatment.

Wink.. Thank You I will be contacting my attorney tomorrow or Tuesday regarding this matter as it was just brought to my attention yesterday when I received a nice healthy bill in the mail from my Docs office.

1171 My case is out of Wisconsin. If they were to offer me a reasonable buyout I would be 100% good with it going into a set aside trust account, at least that way I would not have to worry about battling with them all the time and they would be out of the picture completely. My Doctor visits are merely monthly check-ups and medication refills.. They are wanting me to return to a spine specialists but he is merely gonna tell me the same thing as before. " the surgery is a 50/50 chance of coming out paralyzed" and I am not willing to take that chance.. But who knows they are always coming up with new techniques for doing difficult surguries..

ok today yesterday i called my attorney's office and come to find out he is now working for a different firm and I have to write a letter to his old office to ask them to send my file over to him at his new place.. Is this going to be a mess?? Or can I have someone from his old firm handle the issue?
