what happens in front of the judge
My attorney said we were going to have to go in front of a judge to get WC to pay for my back surgery. What happens when you get there? Something like a mediation. They are not paying for appointments that have already happened and procedures they did even though they are the ones who sent me to the guys. Makes no sense to me..

9 outa 10 you wont even see the judge the lawyers will fuss it out and will tell you all about it the day before or day of court...they have nice little rooms the lawyers go bull kaka in and pretend to fuss make a date for golf and come out and tell us what has been decided...if you have to go before judge most likley he will send you to another doc who will do an IME and that will decide your fate either way worry wont change anything.....

genegene, it's pretty much like Jayne said. Even if you do have to go in front of the judge, more than likely you'll just sit there while the lawyers talk back and forth. Sometimes the commissioner (judge) will ask you a few questions, sometimes the defense may ask a few...your lawyer will sit right by your side and object to any unreasonable questions. Just be honest, maintain eye contact, and keep your answers short and to the point. The time involved will fly by!

Thanks. I wonder if is time for me to start taping things? I have so many people pulling me in 20 directions that it is hard to keep up...I just couldn't understand why we should have to go through this when they are the ones who ordered these visits....I think they just do all this to make people give up, at least I know I am about to that point...

DO NOT GIVE UP! It is for your own well being. That is what they want you to do. You go in and stand up for your rights as an injured employee for all the other injured people out there that need to get their point across. Sometimes they make you to the point of wanting them to go away, and if you do you have only given in to them. Just tell the truth , and you will be fine.

I cannot wait till my time comes, as i have been pushed around also like so many others that are in pain and only want to be cured of their pain and suffering. I wish you the best of luck.

Thanks Sparkey. I'm not going to give up just because it is exactly what they are wanting. It just gets to me sometimes and I know it does everyone else as well. Why in the world it should be that hard to get the care that you need is so stupid to me. If this was a regular insurance case we would be able to sue their pants off for incompetence or something but we can't and they know it. They waste so much time and money trying to get out of doing what they know they should be doing that it is ridiculous.

Gene.....I'm glad you are getting somewhere. Most WC hearings before a Judge are a llittle more relaxed than other court rooms. ALways remember that if you don't remember an answer say so. " I'm sorry I don't rmember, I'm sorry I don't recall". They compare every spoken and written word you have every said from day one. So saying you don't recall is better than getting a date or an incident worng. Best of luck and please let us know theoutcome.

Thanks Cap. This is supposed to be just to try to figure out why they won't pay the bills they are responsible for. I think the lawyer thinks by just calling for a meeting with the judge will show them that I am not backing down from them. I told him yesterday that I wanted all negotiations with them to stop until they can get their stuff together and if he didn't like it that I will find an attorney who listens to what I am saying.
You're right Cap, I will make sure and tell them only what I can definitely remember. I have been through so much and taken so many pain pills that there is alot of stuff that is fuzzy. I will keep you updated as soon as I find out what is going on. I told them to set up something as soon as possible.
