My first post here so a little history.....DOI feb.2010 scaffold collapsed in windstorm fell 18ft landing on my back....T-12 comp.fracture no surgery. No light duty available sat at home till nov.2010 followed by 5 weeks work hardening and FCE. Work Hardening discharge summery states release to medium duty.....my job is very heavy. MMI 12-1-2010. Lawyer says contact employer to see about RTW. Employer asks for perm. restrictions my doc says work hardening report IS the restriction and to follow that.

So I send employer work hardening report with dept. of labor definition of medium duty he says he will call me back? My job was commercial brick and stone masonry which my doctor says I have aggrevated DDD L-4 and should not be going back to masonry but I have a resturant job interview this sunday that I will take the job if it is offered.

Here my first question? If I take the job and 3 weeks from now my employer calls back with a modified position will I be in trouble? They can't expect me to sit at home with no income until they decide to offer modified duty or terminate me right? I have a lawyer and I am suppose to see him next week but I could have a job offer sunday and I need to work.

no. once you are MMI you are suppose to find work within your restrictions; it doesn't have to be with any particular employer.
