Hello,

It's been along time since I posted, I have been busy with school. I never did move back east, because me and hobby have been trying to work things out.

My attorney called yesterday, with the IC's offer of a settlement amount of less than 70,000. I told him I would call him back in a couple of days. Oh; also I asked him what would be the possibility of asking for more money. His statement was,"if anything it would probably be another 1,000 or 2,000 and that it may take another few months for the IC to respond.He said he thought that this is a fair amount.

My question is with this small amount of money does one not get or ask for a MSA? Is that correct? I asked him this question and he sort of brushed me off. If I agree to a stip award how is that paid over time?

Thanks, any information would be appreciated.

WCMSA may be submitted to CMS for review in the following situations:

* The claimant is currently a Medicare beneficiary and the total settlement amount is greater than $25,000; OR
* The claimant has a "reasonable expectation" of Medicare enrollment within 30 months of the settlement date and the anticipated total settlement amount for future medical expenses and disability/lost wages over the life or duration of the settlement agreement is expected to be greater than $250,000.
