yes I could have misunderstood or been confused by her post.
it could be that the carrier thinks she is working and stopped the checks while the employer has refused to take her back rather then her not wanting to return to work thinking she hasn't recovered enough. if the former then the carrier just has to confirm her off work situation with the employer to get the checks restarted. we still don't know what the IME opinion was. |

True and my lawyer thinks that the IME dr said I am fine and can return to work full time. Noone has received his statement as of yet. Either way I was informed by my lawyer to not return as requested to full duty based on treating physician not lifting restrictions. So thats where I am at. Now the question is are they going to continue to pay or will I be fighting this with no pay coming in? I think my lawyer saidthat they have to continue to pay during litigation but if judge orders they were right they will be refunded through a fund set up through some part of the state. I am soooooo glad I got a lawyer from the start cause now that things are going wrong hes all up to speed.

weezle I worked for 10 years as a teacher in the early childrood classroom, this is very physical demanding work!
With young children we work from the floor because they play on the floor, sit on the floor for circle time. The tables the students sit at are small with the chairs the teachers use being short to fit the table. Potty training is spent in the bathroom with a toddler size tolet and small chairs. Playground time is often spent pushing a child on the swing, tending to the child in the sand box which sits on the ground. One day I counted the number of times I kneeled in one hour, 32 times. I counted the number of times I picked up a child in one hour, 56 times. This is not an enviroment for a teacher to be working in with back or knee problems! If you are placed back into the classroom it will likely result in you being reinjured and a student being injured. |

Bummer- I totally agree with you. I too counted while I went back for those 3 weeks. Its rediculous how much you bend, stoop, kneel, crawl, dance..... You name it we do it. This is why my lawyer has told me to not go back even at their request. And I received the notice of ability to return to work from the WC ins. today with the IME's report attatched. Which a lot of it is straight out lies and things he did not even complete and accusations of statements I never said. I am in proccess of getting the files from these other doctors to which this IME doctor is saying is in thier reports. And looking into filing something against them too for falsely recording my medical records. Im outraged as to what the IME reports is in my medical reports from other dr's.

I completed a complaint form today with the Kansas Board of Healing Arts against my treating work comp doctor for the same reason.
I have a witness who was in the exam room with me, and an audio tape plus my notes of the appointments. I sent the completed complaint to my attorney for his imput and will clean it up and mail it tomorrow. |

I wish I had recorded the IME exam video and audio. But its not only what hes saying he did in the exam that he did not perform but what hes is claiming is stated in my other doctors reports that is completely false and if it is in my medical records of my regular doctor then I will be filing something against them.... What I dont know but something along the lines of falsifying(sp? Sorry) medical records.
Edited- just got off phone with treating doctor and he said he is diagnosing me with SI Joint Dysfunction and said that the FCE came back as light sedentary duty. He said that I should talk to my lawyer about having the WC Ins company pay for vocational rehab to train for another job because I probably wont be able to return to a job like the one I had (pre-k teacher). He is also putting me in an SI belt to help control the stabilization of the joint and later down the road if it does not heal I may be looking at SI Joint Fusion. Uhg. Lots to take in. He also said that the IME report is so contradicting that any judge would see right through it. So I guess its good but bad news for me today. |

The wc IME doctor gave me restrictions of lifting no more then 35 lbs, no constant bending or twisting, and I was not rated. The IME report was full of lies!
The two other doctors I saw gave me a rating of 82% and totaly perm disabled. My attorney today said the DA will be involved in the fraud charges against the wc IME doctor. My case with the IME doctor is very similar to yours. I also have SI joint dysfunctions, as well as hernations of the lumbar spine, neurologist suggest a 2 level fusion. I experience the nerve pain in the right hip, down the leg, and into the foot along with burning. Had bilateral carpal tunnel surgery in 09, left meniscus repair, left total knee replacement, right meniscus repair, chrondyl repair, and pica resectioning. I learned in August I have a siginificant hernation of C5-6, with pressure on the cord and displaced nerve root at that level. I received an injury to the cervical spine when the work comp doctor got carried away while doing an exam 7/29/10. |

I have been diagnosed as having SI dysfunction and he wants to do a standing and sitting MRI cause previous ct scan showed L3/4 L4/5 L5S1 bulging with pressure on the thecal sac. He stated he thinks its going to be worse when standing and sitting. Also he believes I have, I dont remember the name, but something where my facet joints slip forward when in upright position causeing disc and nerve issues. Guess we will see after testing. Just frustrated over IME lies. Hopefully all these tests will just shut the IME out completely. Along with all the contradictions alone within the report itself. |
