hello...this is complicated....i live in western ny,and have my fair share of issues...i had a case that i closed out (sec32),back in 05..(low back),been being out from 99-05...got a different job in 07,here the fun part..reinsured my lower spine in 1/09,and filed a claim,was out of work for 3 mths,back to work in.4/09...BUT..at a hearing i had i screwed myself (as my att says),when they asked me if i was on meds at all for those yrs from 05-09..i told them asprain..(being s smart ass)...NOW..the are incorporating my closed case as part of my new problems,saying its a pre-existing injury,..since i cant open the 05 case..IM SCREWED..cause i dont have full coverage for surgery or anything else for that matter now..my problem..i took another job,that i thought i could do.left my job in 8/10,.didnt last 3mths cause of the pain..cant go back to old job cause they wont rehire..i have no medical insurance,my spine doc thinks its more of an hip issue...the hip guy wont see me cause insurance comp wont pay..i have SERIOUS groin pain now,and cant do nothing..my case is a mess.i plan on filing with SSD,and now my attorney is talkin sec32 again..dont no what to doSad.....Sad...

1) Get another attorney, look at our attorney boards.
2) Appeal

your case just seems a mess from your perspective.
these issues are handled every day by comp courts and will be based on the medical evidence. Prior conditions versus current injury is a common issue in every jurisdiction. Resolving differing medical opionions happens all the time in comp cases.
rarely are serious injuries without issues.
while the legal system seems to grind slowly when you are looking for immediate treatment there will be a resolution either from the judge negotiated settlement eventually. until then there are emergency resources available if you look for them

maybe you can use the prior settlement for the ongoing problems that were anticipated from prior injury.

if not, you share a situation with many in this country who are without adequate health care.
you need to contact city and county agencies. there are many who can provide emergency help.
contract your church or fraternal organization. they often have funds available for those in serious need.
contact your union.
the federal government also has programs for those with desperate health issues.

hey i had a deposition and now i am waiting i got my deposition back and now how long do i wait to see whaat the insureance company will do the qme said it work related and the insusurance company is playing game do i get paid now that i had my deposition this is crazy please help

you need to start your own thread.
this one is about a pre-existing comp claim in new york.
if you can contribute to gorgesone's problem great but let's not confuse others by interjecting a different issue.
