Question regarding WC

I was injured on the job about six months ago. Their doctor has had me on No work status for the whole six months. The test (too many to name all) show that that I have bulging disks in my lower back and degenetive disk disease(I had no pain before the accident at all,I worked 12 hrs days with no pain).I also have numbness and tingling in my left buttocks and leg all the way down to my toes. My employer hired someone to replace me on 9/21 of this year told everyone it was my assitant.I had a FCE done and the results were inconclusive as to what my actual permenant restrictions should be.(the tester and I had an arguement over how I would lift a box off the floor if I can't bend over to reach it. I asked if I could start at a higher level such as waist high and he said no.)so the dr said I don't need surgery and that he was going to release me.The DR. said that he could not release me to go back to work or set the permenant restrictions because of the FCE test results.I left a message with my employer and til this day I still have not recieved a call or letter from them. I did recieve a notice from my Insurance company for my regular insurance benefits saying that I was being canceled due to termination of employment for like 4weeks ago.I am still recieving WC benefits on a weekly basis but how long will that last (state law here is 350 weeks)? we they just keep paying me that long?do I have to find another job?Can I move out of state,since I moved here for the job anyway?If WC stops paying can I file for unemployment for the termination? Please help answer my questions if you can.I feel so lost and alone in this situation.I just think that I should not be punished for something that was not my fault. Thank you for your time.

list what state you are in, as Workers Comp laws vary, once you do that, experienced members on this board will be better able to help you.

comp laws in each state are different.
that's why we ask for yours: http://www.workerscompensation.com/forum...?tid=10146 yes, you can move out of state but it might be difficult finding a doc who'll accept your state's fees and reporting requirements. you can file for unemployment if you are able to look for and accept work and are not temporarily disabled. whether you believe god is punishing you or not with your health issues depends on your religious beliefs not on your states work comp laws. |

I am confused on where you read that I was blaming God for anything. I simply stated that I didnt think it was fair that I was being punished for something thats not my fault... I meant being punished by my previous employer for getting hurt on the job because they replaced me. Secondly,the unemployment question was in the hope that I will be able to return to work someday or if I am forced too because they stopped paying my Workmans comp. Last but not least, I live in Northern Indiana and I am aware of the laws varying from state to state.I am sorry if I offended you by forgetting to include the state or by asking a question that upset you.I was under the assumption that I could ask questions and recieve helpfully advice here. 1171 is a very informative person, is blunt in his reply, and has worked as a professional in the area of work comp. Don't really know where the injured workers of this board would be without 1171.
I am an injured worker, bilateral knees, lumbar spine, right carpal tunnel. I do understand how doctors try to down play back injuries. The treating doctor I had said I have strain of the lumbar spine for 5 years. Neurosurgeon says I have herniated disc at 3 levels of the lumbar spine and need a fusion. My opinion, if you are still have back problems, find another doctor. This may be difficult and you may need an attorney to do so. You've had trouble with your employer, doctor, and FCE tester, it is time to find a work comp attorney. Go to the bottom of this page and there is a section on finding an attorney. Good Luck! |

Yeah but always drawing the Comp people to all be bad is his/her personal experience. Stereotyping all the comp people as bad is wrong. 1711 is just one of the people who got burned for being a prick.
Im all good, I got my money coming even when he said expect it to take forever. Have faith that good people are out there and get a solid work comp lawyer with credentials and you will get whats rightfully deserved. But thanks to the rest of you who gave me meanigful answers and hlped me out, this forum is great just som "know-it-alls" can lead you into the wrong mindset. There is help out here, just got to find. Trust me,...Im getting paid! Aloha, from the 808! |

Ah! Everybody's perception is different...and no one's perfect. I've learned this for my own self over the years I've been here. Lighten up and learn a little something from each other.
