|
time limit
if you reported an injury and are now retired, can you file a claim. I worked in ca. and now live in fl. Injury was reported in march of 2009

retirement has nothing to do with filing but time limits do.
did you file a claim form? was the claim accepted or denied? generally in california you have a year from the last furnishing of benefits to pursue an old claim or 5 yrs to bring litigation. |

no. workers comp is not health insurance and doesn't cover your shoulder; it covers only the shoulder event in 2009.
you've had a new injury outside of the job and it would not be the responsibility of a prior employer. the fact that it is to a same area of the body doesn't make it a comp claim. |

Thank you for the reply, helpful. I have retirement insurance and wouldnt want to get caught in a tug-of-war over who was going to cover this, just want it fixed. Thanks again
