What can I do after Workmens comp injury
I am in New Mexico
I hurt my shoulder on the job June 17th of this year taking a panel with no handles of a peice of equipment. I followed work procedures and went to urgent care and was referred to occupational medicine. I got an xray, mri and 3 weeks pt. THis is the same shoulder I had an operation on 1 year before the accident. I was dignosed with severe arthritis and need a shoulder replacement. Most damage was done pre June 17 injury. THe workmens comp doctore released me back to work with restrictions and workmens comp stopped paying. Over 1.5 months later my job let me come back. My shoulder is worse now than before the injury and is not going to get better. Do I have any recourse here towards my company or workmens comp? The company now required special handles to lift those panels now. Thanks |

only if you have medical evidence that your current shoulder problems are result of the comp injury. if you think you have disability and a need for additional treatment you need a medical opinion supporting that.
request another evaluation from the comp carrier. workers comp is no fault and how you got hurt or how the job is done differently now has little bearing on your benefits. find out more about New Mexico work comp here http://www.workerscomp.state.nm.us/ |
