What to do?
Okay here is my situation. Any advice on any avenues will be greatly accepted.
I was injured at work (right back sprain,fractured rib, thoracic bursitis). I am still incapacitated by the pain of my injury. I have also possibly torn my left rotator cuff from over use not being able to lift anything with my right arm. I was laid off while on workmans comp and had to move out of state to be able to survive. When I left the state of Arizona I was told I would continue care in my new state of Illinois. They decided instead to have me get an IME and suprise suprise the doctor said I was fine and released me to go back to work full duty. Well I can't go back to work because of being laid off, and I know I wouldn't be able to the job (pizza store manager) for even a day. I am going to contest the decision but as of right now don't have insurance or money to get second opinion. My question... Is it legal or ethical to apply for a job in the same position I had before, knowing full and well the first day I am there I will be incapable of working and end up not being able to work and I guess filing a comp. claim again? Can I even do this? Should I do this if I can? Is there anything else I can do instead, to get help both medical and monetarily? |

yes you can follow the IMEs recommendations and attempt to return to full duty any time.
you can only file a comp claim if you have a new injury not if you are disabled from a prior injury; an unsuccessful return to work is not a new injury or a new claim. http://findahealthcenter.hrsa.gov/GoogleSearch_HCC.aspx |

Thankyou for the quick response!
Would I not be injuring a "healed" injury. For instance the repetetive motion in my job would aggravate the injury causing a new injury. I feel pretty much normal until I do any physical duties that involve moving or lifting with the right side of my body. We had an employee that was hired with prexisting knee problems. He complained of further damaging his knees by getting in and out of his car on deliveries. I guess this is the avenue I was looking at. I'm just trying to get the company to take care of what they chould be doing right now. |

Btw I am not trying to schister the company. This was a suggestion I recieved and it sounded a little out there, that is why I came here.
I am just so afraid that pursuing it through the court system is going to be a futile, exasperating, pointless venture and in the end I will end up here just like I am right now. Injured, in pain, sleepless, on the internet trying to find some kind of solution to turn my life for the better. |
