what should I do???
I am seeing my surgeon on tuesday and hoping he puts me at MMI. He has made the recommendation that I do not return to my employer.
My employer wants to talk to me about all this as they would not allow me to come back to work on light duty. Lawyer says I should not return to work there either but also advised me to not quit. I am really not sure what I am suppose to do??
Will the doc give my permanent restrictions if this is something he has recommended??? Do I ask him to give me these restrictions??
If I am put at MMI tuesday then my TTD checks will stop and I have no job............how do they expect us to live??? I know they don't care but something doesn't seem right with all this!!!
You are injured from your job and it's like it's your fault.
this system is not right!!!!!!!!!!!!!!!!!!!!!!!!!

RE: what should I do???
Risingeagle222, I am close to wearing your shoes, I will be MMI tomorrow. Not because the dr. said so, But because the state law says so. My medical condition is far from being fixed and it may never be. As far as the employer, I would get a list of the restictions from your dr. and present them to your boss. I am unfamilure (sp) with your state laws. In my state you can not collect unemployment if you quit or are receiving TIB. I believe TIB is the same as TTD. Don't be bashful asking for a list of your restrictions. I saw my dr. the other day and made a comment about having difficulty walking from where I park. He thought that I had a hadicap plague already. He told me to return to his office on monday to pick one up. As far as the next check, I wish I had an answer. If I did, I would know what to do myself. Take care.

RE: what should I do???
In the state of texas, You are MMI when there is nothing more medically to be done to improve your medical condition or 104 weeks from date of injury. In reference to another post you made awhile back. I still have not found out if we get payed during vocational rehabilitation.

RE: what should I do???
AQA- I would be interested in what your rating will be because if you are rated at 15% or more there will be options and possible additional weekly benefits after the 45 weeks are paid out-

Rising-TX has statuatory MMI at 104 weeks of loss time

rising,

I don't think you want to be mmi yet wait until you are completly healed from surgery. In cali we have a 104 week limit too that is 2 years. Ask your doctor if you should apply for SSD. Sorry I can't be of more help maybe limbo or 1171 can help you better. try looking up your state website on w/c and ssdi.
