Work Related Stress/Anxiety
[/font]My question is if my Dr. diagnosised me with work related stress/anxiety is that ground for a worker's comp cased in the state of WV ?

West Virginia specifically excludes mental only claims. You must have a physical injury.
§23-4-1f. Certain psychiatric injuries and diseases not compensable. For the purposes of this chapter, no alleged injury or disease shall be recognized as a compensable injury or disease which was solely caused by nonphysical means and which did not result in any physical injury or disease to the person claiming benefits. It is the purpose of this section to clarify that so-called mental-mental claims are not compensable under this chapter. |

I have Short/Long Term Disabilty, should I be contacting them to see if they cover it ? I have contacted personnel several times regarding my boss and her treatment of me which several other employees have witnessed.

I'm not sure if I understand this corectly, I am from wi and was injured at work in a MVA. It wasnt until a year later I started having anxiety/pannick attacks and my primary dr documented this as a cause from accident and wc has been covering the meds for it........ |

That is a physical-mental injury. Being stressed because of bad treatment by your boss is what is called mental-mental injury and is not covered. |
