Sure, but I don't see an injured worker wanting that. The injured worker would want to be healed first and back to full duty work.

i suspect it depends on the settlement and the issues.
in many states a negotiated lump sum buyout usually includes a resignation contingency. atty tim belt may have more information on the general practice with Pennsylvania comp claims. |

The problem you may have is that he will not be able to respond in a private message because you did not elect that option when you joined the forum. I would agree that often the employer/carrier will require a resignation as part of the settlement. They do this since a subsequent aggravation can be treated as a new injury and they are back on the hook. This results in the practical problem of settlement value. In PA, the carrier will look at their potential future liability when settling a case. If you are working without a loss of earnings, the carrier's projection of potential future liability may be a figure substantially less than what you would be willing to take to walk away from a job.
