Light duty and pay raises
I have been on light duty for 15 months in Pennsylvania. My question is I have been collecting the same rate since day one, but the regular duty position has gotten two pay raises totalling an adittional $1.20 per hour. Am I entitled to an adjustment in benefits since I am on light duty for the same position?

usually your pay for light duty goes off the wages you were making before at your other position. when your initial position recieves a pay adjustment then you should also---but im not from pa!!!!~

I was told by HR Dept that since i am collecting comp that the insurance company would be responsible for making any adjustment if I were entitled. My company's only responsible for paying me the amount that is stated in the light duty offer. The adjuster for the insurance company told me I am not entitled to any extra pay, however I have caught him lying to me before. I have found statutes in other states about this, but have not been able to find PA codes in depth enough to discuss this situation. Any ideas??????????

The formula for partial wage loss in PA is your time of injury average weekly wage minus your actual earnings with the difference then being multiplied by two thirds resulting in your partial rate. Raises given to co-employees will not increase your time of injury average weekly wage. Furthermore, if you receive the raises, your partial rate would go down since your actual earnings would go up, so this is unlikely to result in any real increase to you until the raises result in actual earnings in excess of your time of injury average weekly wage.

Thanks Tim Belt, as I thought it had to do with pay at injury time and date of injury. That was why I asked if they spoke with their employer, as I seen no reason for them to lie to the injured worker about the question.

Once they go back to full duty, they employer in most cases will bring their scale of pay right back where it should be with co-workers. it's just something we as injured workers learn to deal with. Just doesn't pay to get injured at work. It's a terrible thing how so many think being injured at work, they will get the best treatment, best doctor's, and a large sum of money in the end. Just never happens though.
