BBBB, I agree with you 90% as it does relate to my situation. My Dr wasnt going to send me back to work after the last fce was done. I talked to him and he figured I wasnt ready, we decided to let me give it a try, as a test run. And glad he agreed, I have pernament restrictions but my job is below what restrictions say, besides no long standing sitting. I made it almost 1 1/2 years at my job before I aggitated my pre existing injury and now pulled from work, maybe perm.

ahhhhh yes the purest......doesnt matter what the injured worker feels or thinks they must go to work and do......if they are reinjured or are in to much pain to continue then they can call an ambulance to take them to an ER to prove to the DR they cant do it......sometimes the injured worker is just afraid to get hurt again (a valid fear) that needs to be addressed...sometimes once you are back at work you feel alot better just getting out of the house.....

Your rated 8 %, but you never said what part of the body that is for. I would think we could guess for hours on what to say then. You need to explain to those here as to what pain, where, what injury, to what body part.

But, if released to return to work, you best go and try it. If you become in pain working, you advise the employer to send you back to the doctor, then you tell the doctor what is going on, and take it from there. You TTD checks are going to stop, so go to work and try it.

Judge grants change of doctor, and yet nothing changed? So, if you can't advance your case, then you best get an attorney to help you with it.

I would think you didn't have a fusion then? Just removal of some disc materail to take pressure off the nerve. Since that is about all that can be done, I would suggest you try unemployment, as the doctor states you can work, and employer states they have no work.

I injured by back l1 s5 herniated. I had a leminectomy in feb. My job refuses to let me return to work to my original job whic was a truck driver. I still have pain in my back, arthritis in my hip and numbness in my leg. How ill i know if I am able to return to my original occupation if they dont give me chance.

its their job not yours.
if the employer says that your medical restrictions prevent fulfillment of the job duties then you can ask to discuss reasonable accommodation under ADA laws.
safety requirements prevent them from requiring performance above and beyond your medical restrictions.

As one Truck Driver holding a CDL to another then. I ask you this, can you pass both DOT medical requirements? Can you also pass the drug screening? If you answer no to any part of those questions, then you know why the employer can't take you back. And then you know also, you can't blame the employer. Your injury will require a job change, as driving a truck will only cause more damage, and you too should have been told that by now. You can ask the employer to put you in Dis-Patch, or Routing, as you need a job change now anyway.

In other words, your done driving a truck now. You need to get use to that, and start making adjustment for your future. You can seek out a work Rehab program, or ask for one through the WC Insurance to help you find work you can now do and perform, not what you use to be able to do.
