MyBB workers comp/unemployment
I have been on workers comp for one year in NJ and the insurance company has just stopped sending me checks and sent me a letter saying i was no longer eligible. I have not been release by my doctor to go back to work and am still receiving medical treatment. It has been two months since I have received a check. Can i collect unemployement since I am not fully disabled and am been able to go back to work with restrictions. My attorney is trying to get them to start sending the checks again but it has been more than two months. My family doctor will not get involved and fill out forms for nj disability. Help does anyone know what to do?

as long as you are able to work, then yes. If you can not work, then no.

Opps, you stated your able to return to work with restrictions... Why are you not at work then? if able to work, and employer doesn't take you back to work, then yes you can attempt unemployment. Becareful though, if those TTD checks come back, and they pay you for the time on unemploment, you must pay that back then. Use caution. You might want to rather look into State SSI payments instead.

My employer won't take me back. I was trying to get state disability but I can't find a doctor who wants to get involved and the doctor I was seeing won't release me but won't fill out the paper work because he works for the insurance company basically. Any other suggestions.

i dont think you will get unemployment..when my ttd checks were going to stop a while back i was curious and called them to see what i was eligable for and the lady told me if the dr had any restrictions on me what so ever i would not be able to collect benefits and to call back as soon as the dr lifted my restrictions..i dont know if its different by state but im in oklahoma so you may wanna call and check anyway

Every state is different. Without knowing yours, I am limited on giving advice.

I do know in my state. When I applied for SSDI, I was also applying for SSI. I did not need to have any paper work from a dr.. I do know that SSA ckecked with my dr. to get copies of my medical records.

Hence, SSA made the decision. Not the dr..

I am sorry, I missed that.

As I stated. I am unfamilure with your state rules and regs. With that in mind. Can you request a change of treating drs.????

I know when my claim started. I changed drs. about a month latter.
