Right Shoulder Injury
I've been off of work now for 6 months, after having my 2nd shoulder surgery due to a work related injury. My employer wants me back for modified duty and my doctor gave them restrictions for me, which is to not use my Right arm at all, my dominant arm. My question is that if they place me back on modified duty and they can only find part time work for me under these conditions, will they only pay me for part-time work, or will they have to pay the difference so I get full-time pay? I was a full-time employee when I was injured and I'm afraid that if they place me back on modified duty and don't have enough work for me, that I will be making less wages and unable to pay my bills. I'd appreciate any information anyone has to help me on this.

Your state will need to be known for more specific info.

Generally, you would get part time pay for part time work and you would receive monitary benifits from the WC claim. Up to the limit of the state.

california has temporary partial disability.
there is a maximum wage threshold. your lost wages under the threshold will be used to pay disability at the 2/3 rate.
pre-injury wages= 800
post injury wages= 500
partial disability= 300*2/3= $200

Thanks so much. Is there anything I have to do to make sure I get temporary partial disability, or is this something my employer will automatically take care of?

I forgot to ask if any of you know about the time frame on modified duty? How does that work? After my first surgery they had me go back to work on modified duty, at the time they had enough work for me as full time. After, I think it was 90 days they told me that I had to go off of modified duty and they couldn't keep me working because their is a time limit as to how long you can be on it. I had to have surgery anyway, so regardless I would've been off of work. This time I'm going back and will still be rehabilitating my shoulder at the same time I'm working just like last time. My doctor says I have frozen shoulder now, pretty much due to this last surgery and if it doesn't improve I will have to have another surgery. He also said it will most likely take me 1 1/2 to 2 years to recover...if I continue to improve. Will it be like last time, where I'm only on modified duty for 90 days or whatever the time limit is? Or will it continue like that until I either need another surgery or am back to 100%?

I am unfamilure with your state laws and rules. I do know that when I went to work with restrictions. After there was no more work for me. I started recieving my full monitary benifits from WC.
