Question Fire while on restrictions
Well I was hurt at work and had problems ever since from the employer. I was recently fired while still on restrictions and workers' comp said that they have to pay me still since I was still on restrictions. I have asked how long I can collect for but did not yet get an answer. Just wanted to know how long I can collect from workers' comp. or if unemployment would be a better idea. I appreciate any help anyone can give me. Thank you very much!

If your collecting Work Comp benifts then you can't dubble dip and collect unemployment. If injured, no Unemployment isn't better. Persue your work comp claim is the way to go.

Why were you fired?

What State are you in when injured?

Ok thank you very much I knew I could not collect both but didn't know which would be better.

When I was fired it seemed as though it was unclear exactly why they kept giving me the run around.

It has been just over 2months since i've been hurt and was still seeing a chiropractor and on light duty.

You need to get to a real doctor and not a chiropractor. As if your claim continues a chiropractor can be problems down the road.

I would suggest you let us know your State, as it is important. States are different when it comes to work comp.

In georgia it is perfectly legal to fire someone NO matter what the situation !!! not all states are like this, also W/c is the right way to go stay away from unemployement w/c is not taxable unemployment is taxable, also I reccomend you find a good doctor do some checking first there are certain doctors that u want to stay away from some hate people on w/c some doctors hate w/c do ur research! good luck

it's not that you have a choice between comp and unemployment.
if your restrictions are temporary, unemployment will not pay for your disability.
time limits are different for each state.
