Blake are you on any Social Security program now? Will you answer that, as I had asked that before.

They just can't do a medical buy out, I said this already as CMS has changed those rules, and it's not allowed anymore. You just are refusing to believe this, why, I have no idea.

Now listen, FreeBird is telling you good things too, and I do agree with them, but you wont.

Okay, your wife has Insurance now, what are you going to do, when her employer changes Insurance companies, next year or the yaer after, and they wont cover your work injury medical then. It happens all the time, another reason why buy-outs of medical have been stopped.

Where did you ever get this silly idea you can get the medical to be a buy-out?

You wont have this so called saved Nest Egg, when you have to start using it to pay for your work injury medical Bills.

You need to listen up some, for your going in the wrong direction. If you wont listen to me, atleast listen to FreeBird then.

i never said im not listening thats why im asking and no i was denied ss last year said i was too young and i can work only in a restricted fasion. i will let you know when i know for sure whats in stone from my lawyer,

Attorney's are known for throwing there client under the bus. If you buy the BS he is telling you, well...... Good luck because you will need it.
They will catch the mistake (CMS) AND someone or many will "possibly" be heavily fined.

Not only that, what makes you even think the Hearing officer will even award you a Lump Sum settlement? It's a coin toss to what the IC will demand, and what the Hearing Officer will demand. You may never see a Lump Sum, it happens all the time. I showed you what I have sitting in settlement from a 3 level fusion, and was told that was at a close high end, with me returning to work also. But, your right, we will wait and see....

Hi I am from Hawaii and I am faced with a hearing for my back wages, However the carrier did offer me a settlement a very low settlement for my dislocated collar bone and had an IME done which left me with a 12 percent disabled. I still have my back to fight for but was also told to settle because I would not win. For my back the lumbar has been popping by a bulging disc and I am left in constant pain the company/ carrier is saying that it is not a work injury but my doctor says it is there was an IME done or back the doctor who did the IME is saying that its not a work related injury and I have been denied any treatment for my back even though I have had continuous popping of the bulging disc several times after the IME. I wanted to know if I should go with the settling for both my back and collar bone or just my collar and continue to fight for my back? As for my collar bone no doctor will do surgery in the area that is dislocated I got a partial settlement from the carrier but they have a stay motion on my back wages saying that my weekly average was done wrong by the DCD, but when I did the average weekly their way it shows that they have added 2 extra weeks that I did not work at all and was not paid as well. Can they add that 2 extra weeks that I did not work and was not paid?

Wages are based off a 52 week average if that is where the extra 2 weeks came from or what you mean.

As for your back, you have not said what is wrong with it, other then a bulge. I have no clue to what you mean your back POPs, or is POPPING. You would need to say what is wrong with it. You need your treating doctor to state it the back is releated to your work, and injured at work, then you could fight for it.

Not wise to settle one portion and try to fight for the other. That could leave you out in the cold.

If the insurance has sent a letter stating they deny your back, send that letter to your Health Insurance and ask them to cover it. In most cases they will, and you get the treatment you need.
