Filing for SSDI soon after a WC case is over with?
Hello All,
Its been awhile but I am back again.I have now been unable to work for over 2 years due to degenerative disc disease and more and because of a WC injury I received over 2 years ago.The WC case was over 5-6 months ago and I want to file for SSDI.One of the online questions asks if you ever or are you going to file for SSDI benefits.I assume you I would put yes?Then it asks somewhere that you have to give your WC case # and the amounts you received.If I do get SSDI am I still going to get my full amount per month or since I received money from WC claims I wont get as much? or how does this work?Thanks,Born

So it is ok to file so soon afterwards and Give SS all info on my WC settlements they need?Also on the online application there is a space for 750 words or 15 lines for myself to add extra comments about whatever?What should a person write in this space?Thanks Again!Born from Iowa

With this being a holiday weekend many people are not around.

Born, what I always tell everyone, is you gather all your work comp papers, and settlement aggrement. Go to the Social Security Office, supply the information hands down in front of a live person. Talk things over in person, file in person. it's all done and handle the correct way, they make all copies and forward them for you at time of appling.

Go back to ur lawyer that handled ur wc case and have reword the settlement to were it says that you will recieve that money over a life time and he should know how to do it,because if you dont then they will hit you hard for the money you got from the wc case.Trust me I had to do it or I would of lost a lot of money.

Hurt, very good point, as yes, the settlement aggrement does need to say it was paid for over a set number of years, such as like from 2001 to 2031 at so much money per year. Breaking it down, to show a low amount of money is being paid, then is the allowable SS income. Leaving the door open for full SS payments then. otherwise, the settlement money will have to be exhausted first for medical needs. And it will have to be proven also.
