|
I am trying to determine the overall rating I was given of 8% Whole Body Impairment. How does that calculate to ones' abilities? Am I only at 92% at best and that lost 8% may at some point be what I needed to get through a situation etc? How does one at age 52 with present salary at $61,000.00 facing increased arthritic restrictions by medical assesment judge at present a rating of 8% to a level of fair compensation? How does pain and sufferring at the time of incident differ from future compensation assessment with this current overall 8%?
If say pain and suffering where fixed at $500,000.00 and future payment/payout considerations based on 8% whole body impairment given the current salary, where does one start when asked what is fair compensation. Is past lifestyle lost considered? Thanks signed "Both Kness Shot" |

Welcome to the forum.
WC. does not pay for pain and suffering and is state specific. We would need to know your state to give any specific in formation. Take Care 8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom. |

AQA is correct WC does not pay for pain and suffering
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

Jane is correct, that AQA is correct that workers compensation systems have no provisions for pain and suffering awards.
Your impairment assessment has no implications one way or another on issues concerning function. Impairment is a medical term describing a loss of use or derangement from normal. You are asking about disability which is not a medical but a social term concerning inability to meet desired activities more or less. So the two are not easily inter-related and the fact of the matter is that your 8% impairment may cause little or no disability now or in the future. |
