Had my Deposistion!
Hi everybody I had my Depo. today and it was not too bad. Thanks to all your advice And Bad Boy you were right I just told the truth and I had nothing to worry about. Thanks, Well, I will find out on the 26th if they deny or accept my claim My Attorney told me this only beginning!. it's 3 months since the accident! Its a long wait and worry! And no money. I would love to go to work but their is noway I can do that. Does anybody know what comes next? I asked my Attorney but he got a call.

So I can actually change things in writing or do I have to be recorded again. It seems like they wouldn't want you to go and change whatever you want. Like some questions I didn't even get the years right! I just blanked out on a lot of questions. My Attorney also said the main thing this is going to be about is apportionment like how much my back was damaged before the accident. So he said I might even get denied. I was kinda bummed about that but my husband thinks that if I go to court it would be better for me in the end because I would actually get more money. I disagreed, what do you think? Would it be better to go to court? |

each situation is different; it depends on the strength of your medical evidence. your atty will want to settle.
if there is permanent disability it will be awarded by the court in weekly amounts whereas if you do a total buyout it's in a lump sum. in any trial v settlement situation you have to take less to avoid the risk of losing. |

Keep one thing in mind when you go to court it is the judge who decides if you get anything at all and doesnt mean more money in the end.In settlement talks in the end what ever the numbers are is what you will get and in court a judge could throw out somethings in ur case and could cost you money.Been there done that.Good luck with what ever you decide to do and i wish you well.

What do you mean? He can just find something in the end like what? And please tell me I do not have to pay. Oh, I can't wait until this is all over. It's been over three months and my Attorney says it's only the beginning. I want to just be normal again and get back to work. Anyways, thanks for your reply! |

The only thing the judge can find is what the IC has. Or if your attorney is not that good. The attorney cound miss something and the IC will capitalize on. If you are legitimitly injuried and the IC has not over payed you. Then you will not have to worry about paying anything back.
I know you have an attorney, but you may want to educate yourself on your state laws and rules. That way you can make sure that your attorney is really doing what he/she should be. 8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI.
