Light Duty in CT?
Hi Everyone,I was a waitress and was injured in Connecticut. I would just like to thank all of you for delivering all of this important information that is so difficult to find everywhere else! I can't tell you how incredibly helpful everything has been. I injured my back in late 2009. I originally had no intention of going this WC route, as I had my own health insurance. I tried to go back a few days later, and could barely last an hour on my feet. Needless to say, I went to see an orthopedic the next day and haven't been able to work since. Not many issues with the IC, until I started asking questions about paperwork I wasn't receiving. Had an informal hearing, commissioner instructed them to smarten up, and still have not. To top it all off, IC hasn't paid me in 4 weeks, and I'm about to lose my condo. I was just released to light duty, sedentary work, all restrictions noted. My employers say they have suitable work for me to do, and I'm willing to try anything. My question is, how will I be paid? I was originally paid an hourly wage plus my tips, but I never worked a regular schedule, and my averages were different all the time. I would appreciate any advice from any or all! especially anyone familiar with WC in Connecticut or in the restaurant industry. Thank you!! |

you'll be eligible for temporary partial disability payments until you are at MMI.

thanks for the quick response! is there anyway to know how my employer will determine my pay? will it be based on my weekly rate? Or original hourly? Or some other screwy formula?

IN CT, screwy formula. They will pay 75% of your after tax average weekly wage based on the prior 52 weeks income. One thing I would note is that in many states avg wkly wage will be based on hourly wage plus tips you declared. Another good reason for servers to declare all of their income. Not sure about CT. May use rate tables.
