California WC advice PLEASE!
Hello everyone,
I am from California, I am 22 yrs old and have been active my entire life playing football and basketball and any sport that is competitive. I work (worked) at BevMo which is basically an alcohol superstore or for those of us that drink an adult candy shop i was at work on 10/23/2009 and brought a box down from the top stock that was stacked 3 high. Company rule is to only stock two boxes high, i am 6'4 so i was the only person who could get the box from the high spot. When i did bring the box down it dislocated my shoulder backwards tearing my labrum and putting me through some serious pain. When i told my manager he followed protocol and we filled out some paperwork and i went home and iced my shoulder. After all of this i went to the doctor provided by workers compensation, 2 doctors later with both misdiagnosing my shoulder as an AC joint tear, which in my opinion is a cop out because of my prior surgery. I had a grade 4 shoulder separation while playing JR college football. I then went to an orthopedic specialist and he basically told me it was crap because my shoulder was unstable and he referred me to a shoulder instability expert. I then received a bankart repair on january 28th 2010. Since then i have been working my butt of trying to make this shoulder better. I was doing great up until 2 weeks ago when i started to get some serious pain and popping deep in my shoulder again. On top of all the crap from the surgery and rehab the workers comp nurse has been seriously harassing me saying i am not dedicated and a whole bunch of rude stuff. In conclusion i have no idea what to do next. I have contacted a few lawyers because i have been recommended to from some very trusted friends. What are my rights and what will happen next? My medical plateau should be 6 months post surgery which is sneaking up on me. Thanks for reading and hope to hear from you soon. Shawn Long |

if you want another opinion about your condition you can request a consult.
you don't really have to do anything, it'll be done for you. when the doctors determine your condition has reached maximum recovery TTD ends and you'll be given an impairment rating. it'll be used to calculate a permanent disability rating and then additional permanent disability benefits will be awarded. They will advance PD payments after TTD ends you can find out more by reading the PD fact sheet http://www.dir.ca.gov/dwc/iwguides.html |

impairment payments are based on how well you recover. those that don't do well are payed longer then those who recover fully.
have your surgery and hope it is very successful and you hardly get anything!!-- if not, the $$ are never enough for the misery you'll endure. |
