Hello everyone,new from cleve,ohio I been off work since nov 2009 with herniated disk C4-C5 my question is I received a letter from my employer stateing that my fmla was up,but I never filed any papers since I've been out on w/c.can they do that ? also they say i lost my position on april 13,2010 I understand that decision.also they say I will be terminated after 26 weeks.

Yes, they can run FMLA with work comp, that allows you 12 weeks to get back to work. If they are saying 26 weeks, they either have a company polise or a Union contract that holds your job for 26 weeks. Yes they can terminat after such time. But, you can re-apply for work there when your done with work comp, and healed from your injury.

AN employer may use FMLA during your time off work from work injury and does not require the employee to invoke or "sign up" FMLA.
