Fell, while W/C case pending!

Fell, while W/C case pending!
While I'm still waiting for my Attorney's reply, I thought I would run this by you? Since my work related injury in March my left leg would go numb occasionally, then gradually more and more frequently, then toes would tingle and foot would go numb. About a week ago I was going down a small flight of stairs when my leg went completely numb and I lost my balance and fell backward and landing right on my lower back and tailbone! The next day I could not even get out of bed as the pain was excruciating! So to make this short when they compare my new MRI ( which I will have shortly) to the old MRI a year ago will the W/C Drs. blame any further damage on the fall? As it is now they are trying to prove that my back was a prexisting injury which to a certain extent it was. But after my work injury in March now my back is completely shot, leading to the leg numbness, which led to the fall. What do you think? Since it is taking so long for the Attorney to talk to me about this I thought that you all will have some insight on this. ( plus I really like your answers and advice! Thank You! Oh Ya! My injuries consist of several bulging disks and nerve damage, pain is getting worse everyday. I can barely do anything anymore. Tried P.T. that was excruciating! Left after 5 minutes feeling discouraged and depressed. I just want to move forward without so much pain but it's all going backwards. Sorry this was way more than I wanted to say. It just feels good to let it out sometimes. Thanks for listening. Pam

It sounds like the fall is a result of the injury. If you were not injured, then you would not have fallen. With that being said. Any furthure damage should be covered.

8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom.

That is termed a flow through injury and will be attributed to the original condition, Your scenario is pretty common actually, sometimes resulting in a broken leg which then is covered under workers comp. It DOES require a doctor to plainly state that if not for the original medical condition the fall would not have happened; i.e. the one flows from the other.

Treating Doctor has to show on a medical report that the fall was in relation to the Org. Injury is all.
