CONFUSED!

I am from Wisconsin, I was injured on the job in 9/09, strung along for 4 mnths by doc after doc after doc...finally diagnosed with herniated discs at L3-4 and S1-L2...had surgery in 1/10 double discectomy and lamenectomy..surgeon found that a portion of my disc at S1 had broken off and was tangled in my nerve roots. Anyway, back at work full time now..still painfull due to the long process of my nerves regenerating after being damaged and compressed. So, my insurance guy tells me I am going to start receiving permanent partial disability? What is this? How much do I get? Are they monthly payments or, lump sum? Should I get a lawyer? Someone who has been thorugh this before..PLEASE ADVISE!!

there are different benefits for each state that's why we ask that posters give their state.
http://www.workerscompensation.com/forum...?tid=10146 in general, permanent disability is additional payments made when full recovery is not expected. the duration of the payments depends on your impairment rating; the greater the rating the more weeks. a lawyer is not required. without knowing your state I cannot be more specific. |

And just because they are going to start paying ppd, does not mean you wont have more funds awarded to you.. I was involved in a mva while working and have multi injuries, and have been at my mmi for 2 injuries.. And they started paying me ppd on them that were at mmi, off the top of my head I cant tell you the ecxact number but believe its like $260.. x 4 weeks paid monthly... Are you happy with your raiting ( if you had one) ?? I would seriously shop around for a good lawyer and one that mainly does wc only. And make sure he has you in his best interest.. I my self have had not 1 problem with wc but some get the shaft and thats because people are not well informed... Do some research and then decide what your needs are..?? |

Honestly, I don't know what my rating is?? I have my final appt. with my surgeon in July. My Insurance company just told me today that I should expect a check for PPD the beginning of June and every 30 days therafter. He told me that after I am fully released from my surgeon (I am back to work full time now but, with some weight restrictions) that he would talk to me about the PPD in more detail? I am just confused! I am working with General Caualty/QBE and they have been amazing! No IME ever requested, always great with everything so, I am sure they are on the up and up about this. But, they are after all representing my company and not me, right? What rating does a back surgery like mine usually go for? I researched it a bit..it is based on a percentage right? My surgeon told me that after all is said and done, I shouldn't have harldy any residule affects..does this mean I don't get a rating if he expects me to fully recover? If you don't get a rating...do you still get PPD? |

workers comp is not negligence based. there are no payments for pain and suffering etc.
ratings are only given to those who are permanently disabled. if your recovery is good then, of course, the rating will reflect that. it's difficult to have both a full recovery and a big settlement it is likely you will have some impairment especially after surgery. if you do want to try for more $$ then get an atty. most know which doctors will rate a bit higher. |
