you don't have to be employed to file a complaint with either TDI or the feds
you don't have to be employed to file a claim form with TDI you don't have to be an employee to send information and copies of documents to your former employer. Bad: to what action are you refering from my post that requires the poster to be an employee? I don't understand your objection...? |

1171 Wrote:you don't have to be employed to file a complaint with either TDI or the fedsOk So I hired an attorney for wrongfull termination and he told me what they did was wrong and illegal they cant fire you for filing a workers comp claim against your company He also stated that they had no reason to fire me since the doctor took me off work for for the day the company said I failed to show up when I was taken off work |

RE: Fired while on worker Comp
1171, I'm not objecting. I was mostly asking how a fired employee of this State would more so go about this procedure. Such as mostly too, do they want their job back at this point. Or do they just wish to persue a different avenue to being fired. That once we all knew their choice, we can lead them in a better direction.
Sorry if you thought I was objecting, didn't mean for it to come on that way. Now I had always thought there are time lines in filing such a complaint. I not certain what the Statues of Limitations are in this State. I know in my State a complaint would need to be filed mostly in 90 days, but have read in other States that is or could be as much as 180 days. Reply's are intended solely for informational purposes. They are based on personal opinions, experience, or research and are "not to be taken as fact or legal advice", otherwise, always consult an attorney or a doctor. |

RE: Fired while on worker Comp
Abe2141 that sounds rite and maybe more as far a charges go.I dont know ur states laws but they better watch out as when they fire a worker that is hurt at work they open up a can of worms that they wont like if you sue them as I did my company. You are on track so dont give up or in you.I bet this will be settled outside of court as they know they are wrong.Good luck my friend.
Each day is not a rite,it's a given. |
