I am a truck driver. I live in ILL and I work in MO. I was hurt in MO and they filed it and gave me a claim # from MO. However, I hired on with the company in ILL and transferred to the MO terminal. I worked at the ILL terminal for 10 years and have been at the MO terminal for 5 years. There is a BIG difference between the work comp laws in MO and ILL. ILL is much more employee friendly, like letting you go to your own doctor. My question is can I get work comp in ILL instead of MO?

My husband worked for a company in Arkansas we live in Oklahoma.....he had to file in the state he was hurt in..Arkansas....but laws vary state to state check your state laws call a WC certified lawyer for a free one time visit he/she will know and give you an idea of your rights

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

Thank you. I have been told by some people that it depends on what state you got hired in and the amount of time spent in each state. certain criteria would make me covered under the ILL workmans comp. act

Bob, it's only my opinion here for this.

First thing Monday morning make a phone call or 2, to some ILL work comp Attorneys. Ask them since you live in ILL if you can file work comp in ILL even though the situation you stated. They will give you the correct answer though.

It's making me think though, your Work Comp Claim will be in Missouri. And yes, your very correct about the difference in how work comp is between these two States. A big difference.

probably.
you should file in Illinois.
there may be different carriers involve and that may mean one will have to reimburse the other.
depending on how far along the claim is they may not allow a change of jurisdiction.

They (work) filed it and never asked me anything. I got hurt on may 11 and I had a claim # may 13. This company is a 5 billion dollar company and main office is in MI. They have 350 terminals. I report to work in MO but I drive in MO and ILL. Anyway, should I file a claim in IL myself even though work filed it in MO? There company doctor said I would be off 4 at least 3 months. I want to see my own doctor

well thats one thing you will learn quick like i did you play by there rules and laws..i know you would like to see your own dr but if you cant you cant..hope everything works out for you

another Question for you guys/gals. This is a great website for information and opinions. Thanks very much! First, I have never filed a W/C claim and I have been with this company for 15 years. I drive a tractor trailer on a route which means I have to get up and down out of the truck and the trailer multiple times a day. I twisted my ankle getting down out of the truck really bad. The company doctor said ot was a 3rd degree sprain, tore the ligaments. 3 months before I could drive a truck. However he said I could go back monday and sit at a desk for 8 hours a day. It is still so swollen and black and blue and hurts I don't see why I have to go back to work so soon. Can I go to my docter and have him give me another week at least off so I can keep it elevated. Also Im in a cam walker which the docter said take off when I drive my car because they don't want to get sued if i have a wreck. I don't think I should have to drive barefoot to work just to sit at a desk! Anybody have an opinion on whether I have to report for light duty mon. and what if my doctor writes me off? says I don't have to do light duty for at least a week!

You report to work. Yes, do as instructed till something changes that. If you try to go against what is going on, it will have affects on your benefits.

But, you have to make some calls Monday morning. I think for now, you wait till those calls are done. And we can see what direction you can take this.

Thank you Bad Boy Not what I wanted to hear because I have an app. with my doctor. Can I take a vacation day or take the whole week off under FMLA. I have 2 herniated discs T5-6 and 2 bulging discs T7-8 and T8-9 which I did not claim as w/c. When I call in sick for my back hurting which it is now because of the fall it is FMLA. any thought?
