Im in Texas.Ive been out of work since Nov 12, 2010 from an injury. have been getting my weekly checks and this week i found out there were stopped because my DD gave me an impairment of 0%.... I have an MRI that shows multiple discs with a bulge of 2mm out and the L5 disc that is 5mm bulging... the L5 disc is going to need surgery to be repaired, i have gotten one epidural shot and on June 3rd 2010 going for the second one to bring down the inflammation. After that i go in for surgery...... How in the world are they able to cut my paycheck while im going throu the steps for surgery?!?!

it's based on the DD opinion.
it's likely the DD will disable you once you are admitted for surgery.
Not all pre-surgical candidiates are disabled.

First, I am confused in reference to the date you gave. Can you clear that up???

Second, you should have received a letter stating the findings from the DD. In that letter it should have stated what your recourse is. Meaning, how to dispute it.

Third, welcome to the forum.

If You Feel You are being Treated Unfairly, and want to Dispute the Decision, You may want to Speak with a Couple of Attorneys that Specialize in w/c Cases. The First Visit is usually Free, and You May need One to Help You Appeal. I'm also a bit Concerned on why it's felt that the L5 being only Bulged Needs Surgery, Bulges have been known to Subside with Anti-Inflammatory Meds. and Rest. Maybe Yours is Pinching a Nerve and causing Possible Nerve Damage, but I would surely not just let This set as is, You need Some Help on Your Side. Best of Luck!

Texas is the state i am in, I got hurt 11,11,2009 went to the ER 11,12,2009. When i went to the ER the doc gave me a shot and told me to go back to work with restrictions, he said i ONLY had a sprain lower back i said no and got my own doctor.The bulge is pinching my nerve to where my left side hip is constantly numb and i have a tearing feeling on my left hip generating to my groin area, apparently my companies insurance company did not send my DD the MRI, Nerve testing and xrays, instead the DD only got the company doc information of ONLY a sprained back. When i went to the DD i didnt take my meds 3 days prior so that i can shoow him my true pain with out meds... he basiclly said that i wasnt trying at all, when i was in so much pain doing the function test that he asked of me!

oh... sorry! Yes, i need to know what are the next steps i need to take because the DD gave me a 0 MMI, and my insurance company told me to go back to work, but im still in alot of pain when i bend or reach and asically getting out of bed is the worst pain!!

Well if it were me, I go to work, punch in, and if you start to hurt, ask for a slip to go to the doctor again. Your showing an attempt to work, and showing you can't or can work.

Then feed the information back to your attorney...

I can barely take out the trash let alone it takes me awhile and some pain to get off the bed every morning!!! My job has no light duty and i can ONLY return with no restrictions......
