Ok , I do have an FMC from 10 years ago. Not sure they can take it . Award from years ago.

I can see them closing the new claim. Then I would need to petition the court. Which I dont care.

Also not sure if they can do anything without a subpeona first to attend a depo.

I just do not know.

OK. I got it now. The answer is that in refusing the depo, in which you are attempting to establish the legitimacy of your second injury as a new work comp claim, the matter is closed in the defendants favor and you lose. As has been said, comp participation is voluntary and you are free to walk away from your claim at any time. Your plan succeeds in that manner anyhow.

Shadow, I know You don't want to Fight this Round, and that is Your Right. But not Only You can be Deposed. During My Battle with w/c My Dr./Their Dr/, I Testified and so did My Employer, My CPA/They Hired a Forensic CPA, the Pharmacy Manager that fills My Prescriptions/Their Dr.'s that did a Total of 3 IME's on Me all have had the Choice to Either Testify in Court, or be Deposed. When I Won that Portion of My Case, the Defense had to Pay just Shy of $10k in just Expenses for These Depositions. Again that's if You Intend to Fight, if not Your Case will Close, and I would have to Venture to Guess Your Medical will go also. Maybe not Right away, but I can almost Bet that if You don't do the Depo., They will be Petitioning the Court to Stop Your Medical Care. I Hope it doesn't go that way, and the Very Best to You.

I Wish Everyone in the World would Take just One Minute to Take a Deep Breath and Look at the Wonders around Them. Too Much Time caught Up in the Moment can Cause Us to Miss soo Much that is Good, and given Us Daily! We are just too Busy to See!
