Yes I indeed did retain the attorney that I spoke with and took your advice because the School Claims caseworker called me again yesterday basically yelling at me wanting to know why I spoke to an attorney and what I was doing filing a petition to claim. I told her that she obviously received the letter and is aware of who is representing me and if she had any further questions to feel free to contact him.
With in the whole ordeal she did mention that they send my first check out in the mail yesterday morning so they are apparently approving my claim. I will not withdraw the petition until I have the check in hand. Does anyone know for how many weeks the check should be for ? The caseworker told me previously that they pay bi-weekly I have been off since 4-14. Would it go all the way back for the whole month or just the first two weeks and then the next two weeks will come in two weeks ? |

You should Receive probably 2 Checks, as I Believe that's what they are Behind. 4-14 to4-21, 4-22 to 5-6. You have already Completed the 7 Day wait Period, so that's what You should Receive. I'm Glad You Retained Counsel, and My Opinion and I'm Sure Your Attorney's also, will want ALL Calls to be Handled by Him. As My Attorney said as I'm now Disabled, "It's My Job to Deal and Learn to Live with the Pain, and it's His Job to Worry about the Case, that's what I'm Paying Him 20% of My Checks for!" Hang in there, Hopefully things will start to Turn for the Better for You.

Same here. He told me that any communication should go through him and that is stated in the letter that he sent out to everyone. So I am to just tell them if they call that they need to refer all questions to him.
He said that I should not be worrying about anything else but my road to recovery. I so badly want to return to work and I know everyone is pushing for it. I am starting to become a little depressed over the whole thing. Everyone looks at me and says well you will be back to work soon so don't worry too much about things or if they are planning things they say well you will be back to work by then so we will have to do this then or then. I know I should be positive but I, deep down have a feeling that I am not going to be returning in time to finish this school year out. I have a preferred course of treatment that I plan on discussing with my doctor today that includes going to receive my second injection and in the meantime start some PT to learn my restrictions that I now have with my body and what I will be and wont be capable of doing upon return to work if that day ever comes. Then finishing up with the third injection before attempting to return. This should and more then likely will take a good month to finish the treatments I would like to do and that puts me at the middle of June to even attempt at going back and then prob. with restrictions. I see this as being fair in letting me try this route. Hopefully the doc will go for it. Then that will give me from mid June till June 30th at work and then summer off for more recovery time. If I do return and work for two weeks then have summer off and find out that I am unable to return at the start of next school year I can re-open my claim if they close it right ? |

Oh and the first shot has not begun to work as of yet but I am still hopeful. |

I Hope it Starts Working also, but I Fear if it hasn't by Now, it May not. Sorry to Say that, but Maybe the Second One will Kick in. I went Through all of the Shots, PT, Work Hardening, and wasn't able to return, but I Hope You are Exactly the Opposite of Me. And Yes You can Re-Open Your Claim, just Double Check with Your Attorney. You have a Great Plan Figured, Please let Us know how it's going, and I Wish You the Best!

Well back from dr. appointment and it didn't go quit as I was hoping for. I guess he was hoping for better results as well. He scheduled me for an MRI tomorrow morning, 2nd shot next tuesday, and followup w him on the 27th. He also said that if the 2nd shot does not work then we probably wont go any further with the shots. Says he wants to wait for PT till we get some of the pain figured out then open that up. He had a report from the Dr. that did the shot, he also did a physical while I was there, and it stated that based on the findings of the physical it is consistent with serious injury to the L3 thru S1 lumbar region. Which he did all kinds of reflex tests and had me walk on tip toes and heels, bend over, reach, and just plain walk which I couldn't do most of what he was asking.
I told the dr. today that it feels as though I have to keep my hips completely straight and when I walk I have to stride from my knees instead of hip area and smaller strides, if my hips dip or move at all it hurts beyond belief. He kinda looked puzzled by this. He is just a family dr. and my husband thinks I should be going to a dr. that specializes in back injuries. He's prob. right. but I don'd know how to get this dr. to refer me somewhere else without sounding like I don't like his service. So I am off work still undetermined with a followup on the 27th to find out if anything is better and where we go from there. |

Just a Suggestion. Discuss with Your Attorney about a Second Opinion with Either an Ortho. or Neuro. Specialist. (I would Suggest the Neuro.). After 90 Days in Pa if You are not Satisfied with the Dr. You are seeing You can Choose the Dr. of Your Choice as long as They are in the Same Field as Your Injury, which would Include Either an Ortho or Neuro. Specialist. Keep Us Informed after Your Next Shot and the MRI. Best of Luck.

Well MRI went ok this morning, I got a real bad headache during and after it but not sure if thats associated or not. Oh well add one more pain to the list.
First check came in the mail today. It was only for 2 weeks. I tried to call caseworker but no answer. The check showed that it was for the weeks of 4-15-10 thru 4-28-10 so the next check should be for 4-29-10 thru 5-12-10. When would I receive this one ? Can anyone give me an educated guess as to when I should be receiving my checks ? would the weeks end every other wednesday and arrive every other Friday? That would make my next one due to me by this Friday then right ? They are technically behind 4 weeks as of tomorrow, well 2 since I received a check for the first two weeks today. You would think they would offer some sort of pay schedule for you to keep track. |

they only pay when disability is verified. that doesn't always happen on a schedule.

The approval letter that I received states that they will be making bi-weekly payments in a certain amount.
States : weekly compensation rate of $$$ Payments hereafter will be made biweekly starting 4-15-2010 first check mailed out 5-10-10. So are you saying that every 2 weeks they have to verify the disability again ? How ? I have been off work since 4-14 till now that means I should be due 4 weeks WC pay as of tomorrow and was only paid for 2. |
