RE: Losing sleep over this!
you can call the supervisor and complain but it's better to write.
you can also file a complaint with the audit unit
http://www.dir.ca.gov/dwc/Audcomp.pdf
you should send a copy to the claims manager.
you can let your employer know-it's their insurance policy and they can let their carrier know.

Bad Boy Bad Boy Wrote:Do I have a case?

On 3/19/2010 while working as a caregiver in Ca. I attempted to lift a pt. I immediately felt a sharp pain and burning in my back. I called my employer immediatley to report the incident. I had been to the Workers Comp. Dr. twice before in the past year, once for a fall, and once for an assault by a mentally unstable client who had brandished a knife. During the course of those visits I had mentioned my prexisting back condition ( disk protrusions L3, L4, L5- S1 which are at their maximum on the left side measures about 3mm and indents the S1 nerve root). the Dr. told me that my primary Dr. would have to address those issues. When I reported the incident I told them I was sick and hurt my back. My company is now saying I reported being sick but no mention of my back. They are now fighting the claim and have hired a P.I. I'm so confused as to what to do. Should I hire an Attorney? Should I even fight this? Oh by the way I'm new to this site and really can relate to a lot of the pain and frustration that people are feeling. I would love some advise.

How do you know a P.I. was hired? For if you know this, your in comuniacation with someone, and getting information you need.

Next, your wondering if your going to have any problems? it is possible as you stated, you have been informing WC doctor's that you do have ON-Going Pre- Exsiting medical condtions of the Spinal vertebre's and Disc. The P.I. will also be doing medical report findings. This is something normal a P.I. is getting paid to do. Next, the P.I. just may follow you, to see if your staying within the medical Restrictions the doctor or surgeon have you on. P.I.'s are also known to make visits with your neighbors and co-workers. Getting statements to the facts your truly showing an injury to being at work.

Next, in this Thread you stated no one answered you in your other Thread, ( do I have a case? ) yet there were 2 pages of replies on that Thread. I can see you must be Nervous about this. yet, there is little you can do till the Investagation is over. Since there is nothing you can do, I would suggest you keep you mind on healing, and trying to get better no matter what. As that is the most important thing for you. Your Work Comp Case is only going to go 1 or 2 ways. It will be excepted, or it will be denied. And that is that. Then if denied, you have a choice of what you wish to do from there, such as Appeal the Denial. That is all you can do at this point and time. So, relax and heal.

Thank you for your reply! When the PI called me he gave me his name and I googled it. He also sent me a letter for release of medical records. I've been to the Workers Comp. Dr. twice and he told me very little. In my thread when i stated no one answered me, I meant my claims adjuster never answered my calls not the forum. Please excuse me as I'm new to this site so I will try to be more clear! Your reply was very helpful thank you! I just have to relax and wait and see!

RE: Losing sleep over this!
Not a problem, as I don't mind cleaning some things up a little is all.

The P.I. isn't going to tell you anything much. Why, because they don't get paid by you.

Why, oh Why would you sign anything for anyone, P.I. or not, without proper information from the work comp Insurance Ajuster advising you of such people that will be in contact with you, as they had sent them to do work for them. Did the P.I. people show you any proof that they sought information for such Insurance Company, and supply you with names and numbers to call and confirm you should comply with such people?

Now, the Work Comp Claim Adjuster isn't going to tell you anything so you get educated in a work comp system. Neither will your employer. These people don't want you to know your rights under the Laws and Rules of work comp. In fact it is best said, you do plenty of reading, and Re-reading of your State Laws and Rules as they apply to you and your work comp case.

If you need legal advise, it is then best to research ahead of time, for work comp Attorney's. Then when you truly do need one, you can make a good choice, and not just picking any Attorney at will. Work Comp Attorneys are general free till you settle your case, then they get paid out of your settlement. They take phone calls for free, so ingaged in the search while you have time to do this. Search well and hard.

So, you didn't even have before hand information about the P.I. and just signed something, not knowing it was legal or not. WoW is right, what if they wanted your Credit Card number, would you give someone that too just because you were asked too? Your not protecting yourself much...

RE: Losing sleep over this!
good place to start:
caaa.org
they have a zip code search feature.

P.S.
if you would not of signed the medical release forms they would have likely denied your claim. and if you got an atty they would have you answer and sign at a depostion.
you really cannot get out of giving your medical history.

RE: Losing sleep over this!
1171, as I do agree with you.

But, what I am reading here, is this person didn't even have any knowledge, any written information, not even a phone call, stating such P.I. was working for the employer, or the employer's Work Comp Insurance, and just simply gave them their Personnel information. They didn't protect their privacy. I never give anyone information, till I have up-front information that someone would be in contact with me, plus who they are.

This is why I asked, what if they wanted their credit card number, would they have supplied that information also. Yes, I would sign a release to only the correct people that need such information. But, I never in my life will share private information with people I am not aware of. Yes, I would have been nice, collect the people's information first, then kindly asked them to please have their employer contact me first, suppling me with proper information as to who will be in contact with me first.

That isn't too much to ask for, when it comes to ones privacy, and private information. There is just way too much I.D. scams going on these days.
