Injured at a machine shop in Ohio
A fellow employee was injured at work two weeks ago.
We work at a machine shop in Ohio.
He was punctered by a tool and got a serious infection from it. The infection become apparent within 12 hours of its occurance and he had to have immediate surgery to have the infection removed. Doctor has told him he is now out for two months for the wound to heal.
The doctor told him that the infection was so fast and serious because of the coolant that was covering the tool and was in use in the machine.
He filled out the workers comp forms at the hospital.
The company HR department also sent him the same forms and medical record releases to fill out for them as well. Should the company have had him do this, and is it even necessary? Or is it just for their benifit in case of a possible lawsuit/legal action?
Also, he is out of work two weeks now, and his monthly bills are due. How soon can expect to start receiving compensation?

generally it takes 2 weeks from the time the carrier gets the paperwork.

It's all proper procedures, and it is all legal. It's done this way to help the employee and employer get the information out, and the case moving along to better help all in the case.

It is not necessary for him to fill out the forms 2 times. The ones he fill out at the hospital will be all that is necessary, as they will file them with the Ohio State workmans comp and the state will provide your employer with what they need.

It's only my opinion. But, even if the Forms are the same, and the employer wants it filled out, is to simply comply with the request. Fact is, it will give this injured person something to do while sitting home healing, and get their mind off things for a short time. I think keeping the employer as pleased as much as possible will be a major benefit. But, really, what difference does it make if the employer wants their own forms filled out. Simply fill them out, as the employer requested. There is no harm in keeping the employer happy.

Don't fill them out, may just cause problems they don't need. I'm sure this injured worker doesn't want to start with problems right at the start of things.

Thanks for the replies.
He filled everything out as our employer requested, feeling the same way; that it would be better to do as they asked and not cause any trouble.
I'm sure they are just covering all their bases which makes sense and can be to his benefit.
I'll let him know that he can check the status of his claim online. Thanks for that!
