Hello Everyone,

I am a single parent, 2 kids. getting only 300 a wk from insurer, does anyone know if we are allowed to collect unemployment? Its not enough for rent nor food etc. Do you know of other programs to apply for? thank you guys, your awesome.

Hi Toni

You collect work comp because of your injuries and being unable to work.

To collect uemployment one must be able to work, can't collect both at the same time.

Check with your local non-profits, United Way, church, and food banks.

They have programs in place to help families in need.

toni check into applying for SSI and Food stamps for the kids. I would think you would meet there qualifications for them.

Your getting 66 & 2/3 you pay to sit home and heal. That is tax free. Look at you old pay stubs, you will see the amount you get now, is very close to your take home without deductions, deductions are not the tax portion of you take home pay.

Badboy, most states have an earnings cap and high wage earners can loose a lot more then a third.

contact your union; they usually have some funding for members in an emergency. also try your church or any fraternal civic and community groups.
generally the front of your phone book list a number of agencies that can help with particular problems like rent, medical care for kids, transportation, etc.

yeah but if hes only bringing home 300 per week hes no where near the cap..here in oklahoma i b/l the cap is 742 per week

If I have this correct, the injury date was 11/08 and in CA. I believe that the max comp rate for that year would be $916.33. I believe your average weekly wage is based on the average of the 52 weeks earnings prior to the date of injury.

1171 is the CA expert and can confirm if that is correct.

toni, check to make sure your employer correctly reported your earnings; TD is based on gross wages at time of injury.
if you earned more then $450/wk your TD rate should be higher.

I read in an earlier thread that you were rated 14%. I take it you are MMI?? If you were released to work, you can file for unemployment benefits, and look for employment.

If the $300 you are getting a week is PPD (Permanent Partial Disability) then it will run out soon.

Sorry, but I don't know your entire situation.

$300/week is above the permanent partial cap in california so I'm confused as to her disability status--permanent or temporary? did it change?
permanent partial is definately not meant to replace a job; it's not enough to live on.
I did not read any prior posts so until her situation is clarified my recommendations may be premature.
