Lilly...this whole thing confuses me. Hubby was injured. Claim denied. Applied for SSD maybe 18 months later. Denied. Finally after 3 years he won his WC claim. They paid him back to DOI and he started to collect bi-weekly WC checks from Feb. until Sept. when the IC wanted to settle. All paperwork for WC was signed and he was paid his money from settlement before the end of Sept. Wording is in his settlement papers to accomodate one day receiving SSD. He had a hearing for SSD with his attorney present in Dec. of the same year. Was notified within 30 that he had won. Received check (large amount) within about 2 weeks and started to receive regular monthly checks the following month. After about one year he started to receive letters saying SS wanted all of the money back. Talked to the attorney who was of no help. We finally scheduled a hearing and basically what we're being told is that the attoreny at the hearing never submitted his settlement papers. My question was why would you expect my husband to pay back the almost $6000 that he attorney collected. We should have had an answer 2 months ago but haven't heard yet. The interviewer said this is so screwed up , there are so many mistakes made by attorney's and SSD employees that they will probably just drop it. My question is this. I won my WC case last July and have been paid all monies owed me back to DOI. I now receive bi-weekly checks. IF I apply for SSD and get it before I seelte with WC I know I will only recieve approximately the 20% that my attorney gets from my checks and that's fine BUT what will happen if/when I settle with WC. Why would SS owe me anything at that point? My attorney keeps telling me they ask their clients to wait about 6 months after settling to apply for SSD. I think he's full of BS because he was also my husband's attorney. I don't think they want me to apply because then they lose their commision if they have to go to bat for me for SSD. Make sense?> Sorry I am rambling but this SSD and medicare has confused me from the beginning of time. I am hoping that due to my age and the extent of my injuries and other health issues that I am awarded SSD without needing an attorney. I guess we all wish the same thing...................... CAP God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |
