distal bicep tear then tore muscle
i fell at work in may 2009 , had surgery on my right arm for a distal biscep tear. i wass off work until aug. 2009 . when i went back at 100% per the doctor . i could only lift 10 pounds , my empolyer had me lifting 35 pound bags 300 of them in a 8 hour day. i wass in serve pain so i went to the drs. had a M.R.I and the said i tore my muscle . why am i in pain after 2 months ? please help . i have been doing physical therapy . i am also pre-diabetic

Who told you that you could only lift 10 lbs?. was that a permanent restriction, and if so why were you lifting 35 lbs. You never go against your Drs restrictions....
If you reinjured your arm because you went against your restrictions, that could go against your claim, As far as healing sometimes it takes longer , each person is different, Have you gotten a 2ed opinion on your arm? Have you filed this injury as WC? and what state are you in?. Life isn't about waiting for the storm to pass. It's about learning to dance in the rain. |

You never go against your Drs restrictions.... hey i'm in ohio . my dr, gave me no restriction to go back to work . i was only 10 pds. at therapy. i told my boss about it but they told me if i cannt do my job they will find someone else. plus im not sure about going back to work in only 3 month after surgery. thanks for caring |

Were you sent back to work with any written restrictions from your Dr.? If not you need to go back to the Dr. who sent you back to work and tell him what your employer has you doing. ALso Look into FMLA. It will protect your job and benefits for 12 weeks if you qualify for it. There is no law that says an employer cannot fill an IW position. An employer cannot fire you in retaliation for filing a WC claim. Big difference. Sorry I reread your post and you say you went back to work 100% per your Dr. You need to revisit him.

Was this latest injury filed as a WC claim?. What is your Dr saying now about restrictions.? Your treating Dr has to release you before you can go back to work. Are you off work under the Federal FMLA rules, , or just because your injury is not healing . I know ,Lots of questions, but the more answers the better we can help you.

Cap, We must have been posting at the same time. LOL We had/have some of the same thoughts.
From what I understand from Titansfan he/she was injured then went back to work with no restrictions from the treating Dr, but with a 10lb lifting restriction from PT. The employer had him/her lifting 35lbs. and then injured him/herself again, had surgery and now going to PT and is asking if 3 months is to soon after surgery to go back to work. Please correct me if I'am reading this wrong........ Life isn't about waiting for the storm to pass. It's about learning to dance in the rain. |
