In the expanded article at the msnbc link some of those disablities came as a direct result of workers compensaton claims. Seems to me that this could easily be a LANDMARK decision, IF it isn't over turned on the appeal. We can only hope it won't be.
Tipping my hat to the judge , order in the court room, HERE COME 'DE" JUDGE ..UPS best quit digging those holes so deep someone's gonna come along and kick all that dirt in on top of em' and bury them up. They were likely already "feeling the squeeze" after the FED Ex - OverNight merger. Not to mention the market share that DHL is picking up. I wonder if my company is violating the ada laws. in the early 90's they had a dept. made just for injuried drivers. They had about 500 drivers, over the years they have all but closed that dept. down, there is only about 50 to a 100 drivers there and they make you take a test to get into it. Before all the doctor had to say was you were unable to drive and they would put you in that dept.. Since then they have made it so if the doctor says you can't drive a certain type bus they won't let you come back to work until all restriction are off. Seems a shame when a company has about 4,000 buses they can't accomidate you. Since they were the ones that replaced the good driver friendly seats with crap, because they got a cheaper price and decided they would take their chances with workers not filing a claim. |
