Compromise And Release
I have been reading a lot about different types of settlements here. Is the Compromise And Release one that varies by state, or is that an option in all states?

RE: Compromise And Release
comp and release is just that they give you a little money and you lose your job....

;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....Smile

RE: Compromise And Release
Fencer,
Here is a link to the C&S form used in California.

http://74.125.95.132/search?q=cache:_jh5...cd=3&gl=us

Basically, through a compromise agreement, it releases your employer of any further liabilty to your injury. The settlement is usually a bit higher because you cut off the possibility of any future medical.

It is a good way to go if your injury is not life altering, but that is a decision only you can make.

What Jayne said is true. Most employers will only agree to a C&S if you resign or retire. They don't want to take responsibility for any other injuries, and the C&S only releases them from the original injury.

Hope this helps. And, I believe it is basically the same in every State. C&S is a common term used in all insurance claims, not just W/C.

Let Go, and Let God......

RE: Compromise And Release
"compromise and release" has a specific legal meaning and is state specific.
Many states have similar legal agreements that go by different names.
others don't allow them.

Thanks for the replies, I was terminated from my job on the very day that dr said I could not lift more than 10 lbs for the rest of my life (my job was basically being the company "BULL". I live in Mass. and the state website does not offer much info beyond the basics. This forum is a great resource (long time reader).
