I have to agree with Jayne and request a free consult with a workers comp. lawyer. You don't pay money up front, the lawyer gets paid after he gets monetary benefits for the Injured worker. Make sure you take any paperwork that you have recieved from the W/C, included the check stub for the 6Grand. Was your hubby being paid TTD while off work?? If not the check may have been for his time loss. Please make sure and discuss this very soon with a lawyer. I believe too that they may have screwed y'all over, because you didn't have any counsel. You can also find info at the top of this page under state info, which may help you.

Okay, so my understanding is that a settlement is part of a WC process? Why? I didn't think we had any legal issues other that the fact that his bosses are trying to get rid of him. I know it is illegal to terminate his employment before one year from the QME report, right?
I am looking at the check stub issued to him from WC and the description is "Disability, Permanent Partial". Settlement is not mentioned here nor with any conversations taking place between myself or my husband and the adjuster. My husband was receiving WC and state disability when he was out. I am going to seek out an attorney tomorrow. Thanks everyone, now I need to feed my children. Wish me luck! |

some call permanent impairment benefits a "settlement". the language of workers comp can be confusing from one state's system to another.
FMLA gives most workers job protection for 12 weeks. beyond that there are only discrimination provisions which are limited to filing a comp claim. Find one that specializes in comp. Try here and use the zipcode search feature at the top left http://www.caaa.org/ Jayne is such a shill she must of worked as carnie. do your own reaseach. If some of the posters knew so much why are they here? be skeptical. |

we are here to help.....why are you here?mmmmmmmmmm name calling is agaist TOS 1171...no matter we know who you work for.....me never a carnie but I did stay at a Holiday inn several weeks ago.........I worked for the Salvation Army.....and you work for???????????????
