what do i do know that the ensurance company denied my surgery and my physical therapy? they have also hired a private investigator to watch me

Well when the insurance company cancelled my therapy and refused surgery got a lawyer. Then I got another lawyer because after 8 months I was still getting nowhere.
Second lawyer got me a hearing and judge ordered surgery. Injury was 18 months ago and stil no surgery. I tend to think getting treatment is like winning the lottery. Some are lucky some are not. Good luck "Laughter is the tonic, the relief, the surcease for pain" |

I Agree with the Posts above, You Need an Attorney to look into this for You. W/C is a Very Very Tough System to Understand, and a Competent Lawyer that Specializes in W/C Cases is Your Best Bet. As far as the P.I., if You are under Surveillance, ignore them even though You know they are there, and Stay within Your Restrictions set forth by Your Dr. I have Been Injured for almost 4 Years Now, and Have been Watched Extensively, and during the 2 Years My Case was in Litigation, they could not Produce One Picture or One Minute of Film showing me doing things I said I couldn't! Be Truthful with Your Attorney, and allow them to try and Help You! I Wish You the Very Best, and have a Great Evening!!

I have had the i/c refuse P/T and I now have permanent damage because of it. I had then continuously stall without giving permission for a surgery, so my lawyer took them to court and the 2nd day after we got a notice of being put on the docket, the i/c approved the surgery. Now, 9 mo. ago, they denied me seeing a GI doctor, even though I have 4 notes from various Drs. stating that I have to see one for chronic constipation that is directly caused by my injury (rather my treatment for my injury). We have a hearing in a couple of weeks from now.
You never know with the i/c, except to expect them to make it difficult for you. Please get a lawyer and get a hearing on the docket. It is a good chance that once a hearing date is set, they will give in and accept your treatment. They have to pay to go to court and they are just trying to put off having to pay money. you can get treatment thru your health insurance carrier once you have a denial from workers comp.
you can appeal the denial to your states work comp board or commission. |
