medical records
wc is requesting medical records,i have statements from dr. saying that i should be on permanent disability,this is from 2004.this was not a work related injury and due to financial situation i had to keep working.will this hurt my chances to collect disability?[/color]

not necessarily.
california does require that permanent disability from a work injury be offset if there is pre-existing permanent disability from other conditions/injuries. If there is apportionment allowed, your peraming disabililty may be reduced but not necessarily denied. it's up to the doctors whether (and how much) the prior problems left you with apportionable permanent impairment. apportionment doesn't affect temporary disability payments or medical. |
