Court was this morning; it was a long couple of hours.
My attorney told me we are having legal arguments today... In the past this means he would disappear into a conference room with another attorney. An hour later my attorney came up to me and asked, are your ready? We went into the courtroom. The judges started by asking my attorney, why are you here today? My attorney replied we are here to seek medical treatment for my client’s knee, she needs a knee replacement. The judge then responded, is that all? My attorney argued; There are pre-existing conditions, although the condition was aggravated by the work injury requiring a knee replacement. My attorney also presented evidence to support his arguments, court rulings and other documents... The other attorney argued the IME reports that the need for a replacement is due to the pre-existing condition. Focus is being given to the IME reports. In the second IME report the doctor wrote about the pre-existing condition and adds, "If it weren't for the work injury the knee replacement would not be needed at this time." This statement came from a neurosurgeon. The first IME report document the accident the reason for needing a replacement. The third IME reports wc is not responsible for the replacement due to the pre-existing condition. The judge has five day to make a decision whether work comp will pay for the replacement. .............. Tomorrow I return to the Spine Institute and the doctor will go over the MRI of my back with me. Bummer Knees |

Wow...Bummer that was a thorough report. I can't believe the games that they play. Were you in the process of getting a knee replacement...no...you may have had some degeneration, don't we all, but when you fell you were at risk isn't even person over 30 years old...and then you need a replacement. How hard is that to figure out? I am blown away everytime I hear of this stuff. I am so sorry you have to go through all this aggravation all the time. It just isn't right. You are in pain, using a scooter, all the issues that were not there before the injury and they have the audacity to do this...that judge better come back with something in your favor or I am going to loose hope about the human race. If the judge is in favor of the WC Ins Co, do I have the right to appeal the decision?

Bummer in New Jersey you have 60 days to appeal the decision. I am praying that this judge will have good sense.....and judge in your favor. Finger crossed and prayers are climbing....Carol

I will request an appeal if needed. If the judge takes the time to carefully read the reports then I think the decision will be in my favor. |

I had court yesterday and that information is posted above on this thread.
Today I go to the Spine Institute. (I posted the MRI report earlier on this thread.) I am anxious to find what the plan of treatment for my back is. PT tells me my back problems extend to my knee, will they have to fix the knee before treating the back? |
