Not sure what you are asking because there is too little info. But I you get unemployment for a period of time and then WC pays you for that same time then yes you will more then likely have to pay back unemployment. SOme depends on how it is worded in the settlement but both will not pay you for the same time. One thing to watch out for is if you are not suppose to be working because your doctor has put you off work then you can't apply for unemployment because you are saying you can work. Now if you can work but with restrictions and your employer will not work you because of these restrictions you may be able to apply. But again if you get unemployment for this time and then WC goes back and pays you I'm pretty sure you will have to pay back unemployment. If you have a lawyer he sould be able to give you a better idea. Our pay gets cut so bad when we are on WC and it sucks. There are too many rules that keep us from getting double paid even if it doesn't add up to what we made before we got hurt.

NY says I may have to repay but they have not asked for repayment yet. I collected UI 08/10-11/10.
