Does TTD stay at the same rate with a new job? - Vivian - 12-15-2009 06:17 PM Washington state injury here. I was injured in 2003 and received TTD for a while based on my pay at the time of injury. I returned to work at a new job with higher pay. Recently I was put on TTD so that I could receive and recover from carpay tunnel surgery. Should my TTD be at the rate from my old job or would it be based on my current income? BTW this was all one claim not seperate claims. Thank you RE: Does TTD stay at the same rate with a new job? - 1171 - 12-15-2009 06:40 PM i assume you were not at max in 2003 and believe it uses the wages in place on the date of injury. RE: Does TTD stay at the same rate with a new job? - Cervical_Fusion - 12-15-2009 06:43 PM Here in Ohio the amount of TTD paid to you is based on what your wages were on the date of the accident. Right now i am off on TTD and my work accident was in 2001, my TTD wages are based on what i was makeing in 2001 not what my wages were when i stopped working in 2009. Even tho my wages had increased over the years they still go back to what i was makeing when i was first injured. Hope this helps you. RE: Does TTD stay at the same rate with a new job? - Still in Limbo - 12-16-2009 11:50 AM I'm in Pa., and the Rate of TTD is Based in the Original Injury Date, and never Changes. Now if this was a New Claim Your TTD would be Based on Your Current Income!! That's whats so Bad about Pa. Law, if You were Hurt 20 Years ago, and became Disabled and the Ins. Co. Never Settles, You get Paid based on the 20 Year TTD Rate at that Time!! The Only Help a Person in that situation could do is Pray that They got SSDI to Offset the Difference!!

Max does not change. RE: Does TTD stay at the same rate with a new job? - Vivian - 12-16-2009 02:36 PM Bad Boy, thank you for the link. But I've been there and done that. Still looking for an answer. RE: Does TTD stay at the same rate with a new job? - Vivian - 12-16-2009 02:38 PM No, I was not at max rate in 2003. RE: Does TTD stay at the same rate with a new job? - 1171 - 12-16-2009 05:54 PM you might be entitled to use subsequent earnings up to the 2003 max but the authority for such a position is probably found in case law rather then the comp codes. |
