Does anyone know how long it usually takes for the arbitrator to decide weather or not I'm due the medical and back pay on a 19b deposition ?

probably depends on the backlog and schedule of the individual arbitrators.
there might be time limits in your states work comp laws but without knowing yours can't even show you where to look.

I think 19B is from Illinois. Could depend on the nature of the form, and how it was written up for emergency or quick hearing process. You may need to fill us in more then. Alot of 19B,s get priority, and are hashed out on the outside of the hearing, and hearings then don't take place. The 8th floor downton chicago empties out real quick by 10:00AM...Big Grin

Sorry guys that is correct I am out of Illinois , I was injured in mar 09 I went to the ortho doc gave me a prescript and pt. first day a pt I started to have violent spasms went to the emergency room cause ortho was busy and head nurse told me to go to the er . the er doc said stop pt and see the ortho, by that time i wanted a second opinion, wc set me up with their IME after seeing the ime he said your fine return back to work no restrictions,and my injury was not work related .I WAS HIT BY A CAR !!! how the hell else did I obtain these injuries, my mri showed L4-L5 bulging disk and something torn in my knee cap, it feels like a huge hand pick me up and snap me in two , but anyhow so going to deposition hearing next Tuesday, I just wanted to know if i win how long it usually takes to get help i need and my back pay from were they stop back in may 09. Thank you !

Okay, your 5 months in the rear. I'm sure things will get re-instated as in Illinois, the treating doctor's reports hold more weight then the IME does. many times you would see reults and a check right away to up to 2 weeks.

Hit by a car, company car, outsiders car, customers car?

You might have a 3rd party Law suit going on also. if so, then I didn't see why Work comp Insurance is taking a different angle here. for they will recover what they spent on you.

Customer's car, yeah I know no clue why they would make me wait suffer and starve . I've lost 22 pounds not able to eat or sleep very well at all to much pain and discomfort , I'm so mad I fear when i go to this hearing i'm going to unleash a verbal assault on the ic attorney .

Do you have 1 attorney or 2 then. Since it is 2 different cases, and 2 different set of laws. Push your medical and evrything on over to the auto insurance.

emm! I have one attorney doing both cases, first he's doing the wc , is that a bad deal having him do both cases?

Not a bad deal. if they work both Laws for work comp and personnel injury are 2 different sets of Law. Plus, you need to understand, whatever you get money wise from the 3rd party Law suit, your attorney gets their money first, the the work comp insurance gets their money back 2nd, and if some is left, you get that. If the auto insurance is helping to do medical or anything, then I say get them out of the way first, but, it's just an opinion on how I think.
