I am happy I finally found a place that can help that talks 'layman's talk'. Oh, I am in California.

Question regarding WC payments: Do I count them as taxable income when I have to declare any taxable income I have?

Short story: I was told the income from WC was not taxable income. My wife has to go to court because her ex has not been paying child support. She has to let the judge know the combined taxable income we have; so does she have to include WC payments with taxable income?

Additionally, getting only 2/3 of what I make has caused bills to start to pile as obviously they cannot all be paid with 1/3 less income. Are there any type of programs out there that can aid ones like us who survive paycheck-to-paycheck?

Hi Zara, and Welcome to the Forum! The Reason w/c is not Taxable is Because they only Pay You 66 2/3%, the Other Percentage not Paid should be Pretty Close to what You Paid in Taxes. Unless of Course You made Much More than the Max. amount in Your State, then they will only Pay You that. I'm not an Attorney, but I don't Believe that Your Income should come into Play as far as Your Wife's Child Support while You are on w/c. I Hope I'm Correct, and Have a Great Day!!Wink

SmileTongue can anyone tell me in layman terms how it works in west va. I broke my back 8/15/2008 and have been on w.c. since however it is about to run out and the lawyer says the laws in west.va are all for employer and i cant work anymore except too be a welcome man at wallie world . he said they do not pay loss wages pain and suffering,ect i may get 250 the most will be 5000 how can anyone live on that maybe i missed something PLEASE HELP!!!!!!!!!!!!!

you should start a new thread.
if you are only partially disabled you will be expected to return work within your restrictions.
the additional impairment $$ is not a substitute for working.

I think what mnm is saying is he is the injured worker, claim was in WV and than moved to California, and it is his wife taking her x to court because of child support, and the court needs all of there combined income, and is WC considered income in this case.

Then he go's on to ask a question on his own WC claim. MNM correct me if I am reading your post wrong,

No i was injured in west va. and live in va. this case is a nitemare. finally found a lawyer but he said i can only expect 250.00 the most will be 5000.00 for a perm. broken back Just doesnt sound right
