Compensation Court Date - lil_conner23 - 07-26-2009 02:31 AM Name: Jill Location: Pittsburgh, PA. Age: 20 DOI: 8/9/06; I was 17. My question is this: In the beginning of my compensation battle, so to speak.. I had no problem getting weekly checks, etc. Later on I had to get an attorney when various surgeries were getting denied. So now, I've been off work since Feb. 17th, 2009. Worker's comp has denied payment for surgery, sent me to an IME.. he said surgery yes, but not for a year or so.. went back to my doctor, he says no, surgery now. (making the story short) Anyway, they haven't been giving me weekly checks since the 17th. I'm going to court over this on Wednesday. This is my first hearing. What can I expect, anyone know? Depending on which Dr the judge finds more credible will be the decision factor . The judge should order the IC to continue checks based on your disability rating of TTD or PPD . I seen an IME ..he said I could work light duty until a year passes, then I should have surgery. My doctor who put me off work said, no.. you need surgery now. So I'm fighting for surgery..I have a utilization review, but wednesday i go to court for my weekly checks. I was just curious, am I wrong at all here? What do I expect? I've never done this RE: Compensation Court Date - Still in Limbo - 07-26-2009 01:22 PM Your Attorney, and Their Attorney will give the Judge the Evidence needed, and You May also need to Testify. I'm just about 30 Miles South of You, and My Case is in a Different County, but I See No Reason that the Judge will Rule Against You, the Evidence seems to be on Your Side! Your Attorney should have also Filed a Penalty Petition for Non-Payment, and if Ruled in Your Favor, You should Receive All Back Monies Owed, with 10% Interest, and Possibly some Penalty Money, anywhere from 10-50%. You May also get to the Hearing, and the Ins. Co. Attorney May want to make a Deal with You and Your Attorney before going in, I had that Happen to Me when We had them Dead to Rights before! I just Hope Your Judge makes a Decision Quickly! Best of Luck!!

If they ask to make a deal, you mean settle? I'm supposed to have 1 of possibly 3 more surgeries just because the procedure isn't known to be so 'successful' so I don't plan on doing that anyway. lol I'm only 20 and they really messed my hand up. I honestly don't know how I'd ever have a child if I wanted to, I cannot lift anything it seems. It has been since feb. 17th im off work with no check. On top of that, my employer violated a child labor law concerning me and he is to pay me an additional 50% of whatever comp gives. So do you think my employer will be there as well, because he hasn't paid me either. |
