Impairment rating - StarElaine - 01-30-2009 02:12 PM

I just found out that the Doctor I saw on January 7th gave me an impairment rating for RSD of 4% and back dated it for October 15th, therefore I was supposedly over paid over $3000.00. What should I do next?

It was a Doctor that the W/C sent me to. I have not gotten the impairment letter yet, so I called the adjuster to find out where it was. The adjuster was the one who told me the rating and the results of what the Doctor's report was.

some workers request a copy of the rating report and discuss it with their treating doctor. There is nothing you are required to do.

if you want to appeal the denial of benefits then you can file with your state's work comp board.
you should list your state in your user profile as the rules are different for each state work comp system.

I am in Texas. I have not gotten anything in writing. I haven't even gotten the letter about the impairment rating. This week my TIB didn't come, so to find out what happened. I called the w/c adjuster to find out. He was the one who told me what the rate was and that the rating was back dated to October 15, and that I had been over paid.

First off RSD is a very debilitating thing to live with. What part of your body do they claim you have RSD? Has it spread to another part yet? I have been also diagnosed with that and it is very hard to diagnose. It took almost 2 yrs. to have my PM finally say I had it. I am still unsure I have it as I have never been tested for it.

When you have RSD there is treatments such as gangloin block injections , narcotics, stimulators etc. It is very painful and It can get worse over time. I cannot see how you only got a 4% rating for being diagnosed with that. Mine started with recurring carpal tunnel. It is in my dominant hand and just over the last few months it has spread to the other hand/shoulder. I have had the injections that failed to work and now the doctors are suggesting a stimulator trial.

I just do not see how the WC IC can come right out and pay you 3,000.00 and no more benefits for you when these benefits are very much needed to maintain your pain level. It is a chronic pain condition and I would definitely find another lawyer that will fight for you. It seems the one you have is no help at all. Something just does not seem right. You should be in PM or under the care of a specialist that deals with RSD.
